WHEATON, Md. (AP) - Montgomery County is suing the Food and Drug Administration in an attempt to overturn the agency's decision not to grant the county a waiver to import prescription drugs from Canada for public employees.
The suit has been filed in federal court in Greenbelt, Md.
County Executive Doug Duncan, who made the announcement about the suit at a senior center in Wheaton Thursday morning, says it's "fundamentally unfair" that people in Canada pay a fraction of what Americans pay for the same drugs. Montgomery County, which is home to the FDA, was notified in November that it would not be allowed a waiver to allow county employees to buy cheaper drugs from Canada, a program that had been approved by the county council.
Vermont sued the FDA in 2004 after its request for a similar exemption to import Canadian drugs was refused, but a federal judge threw out that lawsuit.
The FDA maintains that importing drugs from Canada is illegal, saying it has little control over the safety and quality of those drugs, many of which are made in other countries.
